It was a fun win-win solution for all!
This June, 2024, Bill and I were in Georgia for a week, prior to heading to Nashville for the RV REIA Event. Most of our rental houses are in Georgia and we had a bit of work to do to get a house ready to rent. I had a slow day, so I decided to door knock some of the properties that were scheduled for the July 2nd foreclosure auction.
On the 4th door I knocked on, I was invited in. The homeowner (Melanie) was laying sideways on the sofa and was deathly, pastie white. I was immediately concerned about the woman and asked about the problem. Turns out, there were many!
** Melanie was 8 months in arrears and facing foreclosure in 14
days.
** Melanie had NO money to bail herself out, and her two grown sons had basically thrown up their hands in frustration with their mom’s poor choices.
** Melanie was a hoarder. Her house was packed to the ceiling with stuff. She couldn’t
access two of the bedrooms and only had a deer trail to her bedroom and bathroom. Crazy.
** Melanie was in poor health ~ two heart attacks, three stints, diabetic, and a plethora of other ailments.
** Melanie had given almost $60,000 to two internet scammers who
promised her love and jewelry. This money was a combination of her inheritance from her mom ($40,000), money borrowed from a friend ($2,000), and money that was supposed to pay her mortgage ($7,000+).
I sat with Melanie and her boyfriend, Tim for well over an hour. During that time, Melanie’s phone rang constantly with calls from investors
wanting to buy her house. Melanie said she received about 60 calls a day with offers from $125k to $150k, and most gave her less than 30 days to move from the property. Prior to me, only one other investor had knocked on her door, and that guy demanded that she vacate within 10 days of purchase. Problem was, Melanie didn’t want to move.
So, falling back on the lessons I learned from Bill, I offered to pay up her arrears in exchange for an Option to buy her house sometime in the future. This way, Melanie and all her stuff could stay in the house. Melanie LOVED that idea and wanted to work with Bill and me.
I left Melanie’s house and raced
home to get Bill (we were in the motorhome and only brought one car with us to Georgia). After sitting down with Melanie and making 8 pages of notes about her dire situation, Bill offered her this solution:
** We would catch up her arrears ($7,620) and stop the foreclosure.
** Melanie would give us an Option to buy her house anytime in the next 30 years.
** Strike price (purchase price) would be the mortgage balance ($80,000 minus $7620 arrears).
** We agreed not to
exercise the Option in the first 8 years.
** When we exercised the Option, we would take the house subject to Melanie’s mortgage.
** We would keep the house as a long-term rental for as long as we wanted. But when/if we eventually sold the house, we would split
the net proceeds 75/25 with Melanie.
Melanie loved the idea and accepted our offer. She accepted ours, over all the other offers she received, mainly because she didn’t have to move.
So on the following
Thursday ~ 6 days before the foreclosure auction, we raced back from Nashville to meet Melanie at our real estate attorney’s office in Georgia and sign the paperwork. Melanie deeded the property from her personal name into a title-holding trust with her being 100% beneficiary of the trust. Then our attorney wired funds ($7,620) to her mortgage company. This brought Melanie’s mortgage current and stopped the foreclosure (scheduled for today, July 2nd).
Whew!
By the way, the house is currently valued at $265,000. Remember, our strike price is $80,000 minus the $7,620 arrears. And when we exercise our option, we will take the house subject to the mortgage balance. This gives us control of approximately $193,000 in equity.
Was this a good deal? You bet it was!
